One of the advantages of the Workplace Relations Commission complaints handling system is the ease with which an employee can submit a claim.
There is no cost involved and filling out an online complaint form is all that is required to get a claim in the system.
This can be a problem for employers because the employer must defend, or settle, the claim. Regardless of how well founded (or otherwise) the claim is.
The system can be exploited, to a certain extent, and the employer may well be forced to compromise/settle a claim simply because it would incur a greater cost to defend the complaint at a WRC hearing, no matter about the merit of the complaint.
