The paucity of Enoch Burke’s argument

I saw a video yesterday on X in which Enoch Burke explained to the interviewer that when a person goes to court they should be given their rights.

And because this did not happen in his case the courts got it wrong and the dispute with Wilson’s Hospital school continues.

The paucity of this argument is stunning.

It overlooks entirely the rights of others. For example, the child’s right to an education, the school’s right to own and enjoy private property, the school’s right to discipline employees, and so forth.

When you go to court to enforce your rights they are often in conflict with the rights of others. And the court has to engage in a balancing exercise between the competing rights of the parties.

Enoch Burke’s rights to believe in God and practice his religion is not at issue. But his rights do not trump the rights of everyone else.
