Our first Injuries Resolution Board mediation

We received our first invitation this week to a mediation by the Injuries Resolution Board.

This is a new development which I believe commenced in 2024 and covers workplace injury and public liability claims. Road traffic claims are to be included later in 2024.

You must indicate at the outset on the claim form which is submitted to the Injuries Resolution Board that you are agreeable to mediation. The other party must also indicate their willingness to participate in mediation.

If you are not happy with the process, you can leave any time.

If you come to an agreement, assisted by the mediator, an agreement will be drawn up by the mediator for both parties to sign. There is then a 10 day cooling off period.

If you do not reach agreement the Injuries Resolution Board will make an assessment, if the other party is agreeable.

If agreement is reached and the 10 day cooling off period elapses the Injuries Resolution Board will issue a legally binding order to pay.
